LICENSES AND SOFTWARE This software and documentation is licensed not sold to you under this agreement. This agreement specifies the terms and conditions under which you, the "User," may access, install and/or use ("use") the software (source and/or object code) and/or related documentation. Your use of the software and/or documentation constitutes your acceptance of the terms of this agreement between you and Scientific Instrument Services, Inc. (SIS) If you do not agree to the terms and conditions of this agreement and do not want your act of using the software and/or documentation to indicate your acceptance of the agreement, promptly return the software and/or documentation and proof of payment to SIS for a full refund. Scientific Instrument Services, Inc. (SIS) hereby grants to the purchaser (the "LICENSEE") a limited, revocable, worldwide, non-exclusive, nontransferable, non-sublicensable license to use the Software, including any minor version (1.x) upgrades up to, but not including, the next major version (2.x) of the Software. YOU MAY - Use the Software in conjunction with a single, fixed, licensed copy of SIMION OR (at your option) with more than one copy of SIMION but only by a single user. - Modify, adapt, or create derivative works, in source or binary form, of the Software for personal use. Such derivative works may also be distributed to other SL licensees, and only to other SL licensees, provided that this same license is applied to the derivative work. SIS retains the right to incorporate such modifications into the standard version of SL. YOU MAY NOT - Alter, modify or remove any copyright or other proprietary notices included in the Software or Documentation, including derivative works thereof, or any copies thereof. - Rent, lease, license or otherwise transfer, distribute or disseminate the Software or derivative works thereof, or Documentation to any non-licensed person or entity, including by posting it on a public network, without the express written consent of SIS. DISCLAIMER OF WARRANTY The software is provided "as is" without warranty of any kind. To the maximum extent permitted by applicable law, the author further disclaims all warranties, including without limitation any implied warranties of merchantability, fitness for a particular purpose, and noninfringement. The entire risk arising out of the use or performance of the product and documentation remains with recipient to the maximum extent permitted by applicable law. In no event shall the author or the authors of any contained software be liable for any consequential, incidental, direct, indirect, special, punitive, or other damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business information, or other pecuniary loss) arising out of this agreement or the use of or inability to use the product, even if the author has been advised of the possibility of such damages.
